How much do you charge to file bankruptcy?

It is hard to answer that question because every case is different. Many people who think that their cases are very simple are actually train wrecks waiting to happen.

For that reason, I DO NOT CHARGE FOR THE FIRST APPOINTMENT AND WE GO OVER YOUR WHOLE SITUATION AND I CAN TELL YOU WHAT YOUR OPTIONS ARE AND EXACTLY HOW MUCH IT WILL COST THEN. 

If your case is a chapter 7, then, in most cases it will be more than $1000.00, BUT I will take payments and give you 6 months or more to pay me, if you have that much time before you need to file. The costs that are not included in attorneys fees are listed in this website. For a $400 down payment on whatever the fees and costs turn out to be, you can tell all of your creditors to start bugging us instead of you.

IF YOU NEED TO DO A CHAPTER 13 AND YOU “QUALIFY” then I will take 100% of the attorneys’ fees under the payment plan with the Court. The attorney’s fees are $3000 in SC and $3500 in NC (for the “average” case).

To “qualify”:  (1) you must have no “feasibility issues” (which means you have to be able to afford a payment plan under chapter 13…duh); (2)  you must not have had a chapter 13 dismissed within the last year (this requires extra hearings in SC and your case is not as likely to go through, which means that I might not be as likely to be paid anything if I put 100% of my fee in the plan); (3)  you must be able to afford a plan which has enough room in it for attorney’s fees to be paid (I cannot afford to have you pay me $1 per month for 3000 months); and you must have all of the requested information we need organized and brought to us in a timely fashion…you are paying us to do LEGAL WORK FOR YOU (do not expect us to spend all of our time organizing your stuff when you bring in a bunch of garbage you dragged out of your closet, the trunk of your car, and from your kids’ bookbags and threw it in a grocery bag for us to decipher; if you don’t want to do it, we SURE don’t want to do it…..I once had a client who brought 5 years’ of tax returns in to be covered in dog urine; he’d lost his mind, evidently).

Of course, even if you do not “qualify” for having 100% of your attorney’s fees paid under the chapter 13 plan, we still put MOST of them in the plan.
