That court date isn’t good for me. Do I have to go then?
Short answer: YES.
There are very few court dates that most debtors have to attend. Usually one, which is the meeting of creditors. These are set by the clerk of court for the bankruptcy court and only can be continued or changed with a doctor’s excuse. If you are old or infirm, then you might be able to do your hearing by telephone but there are very rigid requirements to meet and rules to follow to conduct them. They are rare.
If you miss a hearing, it may be continued once, but you will have to pay your attorney for two hearings, because he still has to be there. If you miss two, your case is dismissed. No excuses.
The best thing to do is talk to me beforehand and we can time your filing so that your hearing won’t be scheduled when you already know you have a conflict.
