Will my employer know about this?
If you file a chapter 13 bankruptcy in SC, then there is a good chance that your employer will be required to deduct your chapter 13 plan payment from your paycheck and mail it to the chapter 13 trustee every month. They do this in NC at times also.
If the trustee asks for the payroll deduction and you want to fight it, you have to ask the judge not to order it. Usually, you will lose.
Otherwise, unless your employer is a listed creditor on your bankruptcy or you have repaid a loan to your employer shortly before you filed bankruptcy, it is doubtful that anyone else would have reason to notify your employer, unless it was to intentionally embarrass you. I have been told of that happening once.
It seems that a bigger problem is that of creditors calling debtors at work and harassing them or constantly asking for them before a bankruptcy is filed.
If you file a chapter 7, except for loans from employers, there really is no reason for the employer to know.
