Can I lose my job for filing bankruptcy?

It is illegal to discriminate in employment because you have filed bankruptcy. Of course, you would have to prove that your filing bankruptcy was the reason you were terminated. In the perhaps 3000 people I have represented in bankruptcy over the last 22 years I can only think of 2 people who informed me that they lost employment due to a bankruptcy filing; one worked for a bank and quit, and another had a company credit card issued to them and the company did not like that. Thus, I can only presume that losing one’s job because of filing bankruptcy is rare. If you ever have that problem, let me know immeditately.

  • Can I go to Jail for not Paying my Bills?

No, not unless you committed a crime in the creation of the debt (for example, fraud). Simply borrowing money and not being able to pay it back is not a crime. Many creditors representatives will tell you lies on the telephone and say that they will have you put in jail. Perhaps they are too ignorant to know they are wrong or that it is illegal for them even to say that. See More Bankruptcy Q&A
